Powrmatic, Inc. guarantees that the Thermal Economizer System will perform as presented to the person or persons making the original purchase decision. The person or persons must be fully acquainted with the Thermal Economizer, including at least one visit to a current installation.
If the decision-maker is unhappy with the performance of the Thermal Economizer System, they shall notify Powrmatic, Inc., in writing, during the first year of installation. Powrmatic then shall be given the opportunity to see the System, evaluate the complaint and make any adjustments felt necessary to overcome the problem. If additional heating and/or air handling equipment is required, Powrmatic will determine the type and supply this equipment at no added cost. It will be shipped FOB, shipping point, will full freight allowed. Installation of this equipment shall be at the expense of others.
If Powrmatic, Inc. fails to satisfy the person making the decision to purchase the equipment, then the customer has a right to remove the equipment and return it to Powrmatic, Inc., freight collect. Providing that the equipment has been subject to normal use and handling, an amount equal to, but not exceeding Powrmatic's original invoice, will be refunded.
This guarantee is subject to the following exceptions:
- When there is excess infiltration of outside air due to poor discipline and/or other uncontrolled building openings.
- When System is operated under negative air conditions.
- When inaccurate information is supplied for design purposes.
- When the System is not properly installed, applied or operated in accordance with Powrmatic's recommendations.
- When Powrmatic does not perform the calculations, determine the size and number of units required, and agree to the proper locations of such equipment.
